Louisiana Fault and No-Fault Divorce

Louisiana offers no-fault divorce under Article 102 and Article 103. Couples bound by a covenant marriage must file for a fault-based divorce.

  • Article 102 divorce: There are two separate parts to filing for a "102 divorce." The parties must first file the divorce petition. Then, following a waiting period where the parties live separately for a continuous period of more than 180 days (one year if children are involved), a motion may be filed to finalize the divorce.
  • Article 103 divorce: When the couple has already lived separately for a continuous period of more than 180 days (one year if children are involved), the couple may immediately file for divorce and petition to have it finalized.
  • Covenant marriage divorce: Under Louisiana law, parties to a covenant marriage must file for divorce in accordance with one of the state's fault-based grounds for divorce, such as adultery, physical or sexual abuse, abandonment by one party for a year or more, one party is incarcerated following a felony conviction, or the parties have been living separately for more than two years (or for one year from the date of a judgment separation from bed and board).
